These Terms of Use (“Terms”) govern your access to and use of the Astricks website, applications, and related services (collectively, the “Services”), operated by Astricks (“Astricks,” “we,” “us,” or “our”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

  • Astricks may remove any User Content that violates these Terms or that we determine, in our sole discretion, to be objectionable.

  • Upload or transmit viruses, malware, or other harmful code

The Services, including all content, features, and functionality (excluding User Content), are owned by Astricks or its licensors and are protected by copyright, trademark, and other intellectual property laws. No rights are granted to you other than as expressly set forth in these Terms.

7. Third-Party Links and Services

The Services may contain links to third-party websites or services that are not owned or controlled by Astricks. We are not responsible for the content, policies, or practices of any third-party websites or services. Your use of third-party websites is at your own risk and subject to their terms.

8. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE, TO THE MAXIMUM EXTENT PERMITTED BY LAW. ASTRICKS DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASTRICKS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ASTRICKS’ TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ASTRICKS IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

10. Indemnification

You agree to defend, indemnify, and hold harmless Astricks and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your use of the Services, your User Content, or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice, including for violation of these Terms. You may stop using the Services at any time. Provisions that by their nature should survive termination (including Sections 6, 8, 9, 10, and 13) will survive.

12. Changes to the Services or Terms

We may modify or discontinue the Services, in whole or in part, at any time. We may also revise these Terms from time to time; the “Last Updated” date reflects the most recent changes. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law and Dispute Resolution
